Constitutonal complaint pursuant to Article 127(1) of the Slovak Constitution represents the sole constitutional tool of direct access to constitutionality protection for individuals and legal entities
Constitutional complaint for violation of fundamental rights and freedoms may be filed by an individual or legal entity complaining that his/her fundamental rights and freedoms were violated by a valid decision, measure or other intervention. A complainant needs to be represented by a lawyer in proceedings held at the Constitutional Court. Constitutional complaints may be filed within two months from the day when the challenged decision, measure or other intervention became valid and final providing any and all available regular and extraordinary remedy tools were applied.
Constitutional complaint is an extraordinary remedy tool for arbitrary decision in which arbitrariness and intervention into elementary rights and freedoms exceed the constitutionality limits.
