To be granted a temporary residence permit for the purpose of employment requires a lot of administrative actions and steps to be taken from hiring a foreigner to be employed in Slovakia up to his/her start in the new job. There are many legal duties to be met by the employer who wants to employ a foreigner from non-EU countries. The vacancy needs to be reported electronically via www.sluzbyzamestnanosti.gov.sk portal by the employer at least 20 workdays before the temporary residence application for a foreigner is filed. If the vacancy remains available and at the same time, the respective Labour Office would not reject the vacancy for a foreigner, the latter may then file a temporary residence application in Slovakia for the purpose of employment. “Promise to employ the citizen from a third country” issued by the future employer is a precondition for filing a temporary residence application. The employer may conclude the employment contract with the foreigner only after he/she was granted a temporary residence permit in Slovakia for the purpose of employment. It is advisable to provide legal assistance to both the future employer and the potential employee in parallel, with the aim to ensure the required quality of necessary documents that would facilitate smooth and seamless residence proceedings.
